Terms of Service: Legal Framework Governing the Use of Riyadh Residences

The Platform is provided on an informational basis only. Nothing published on the Platform constitutes, or is intended to constitute, investment advice, financial advice, legal advice, tax advice, or any other form of professional advice. The content published on the Platform should not be relied upon as a substitute for consultation with qualified professional advisors who can evaluate your specific circumstances, objectives, and risk tolerance.

User Conduct and Prohibited Activities

Using the Platform to transmit, or procure the sending of, any advertising or promotional material without our prior written consent, including any junk mail, chain letter, spam, or any other similar solicitation. Impersonating or attempting to impersonate Riyadh Residences, a Riyadh Residences employee, another user, or any other person or entity. Using the Platform in any way that infringes any patent, trademark, trade secret, copyright, or other intellectual property or proprietary rights of any party.

Systematically retrieving data or content from the Platform to create or compile, directly or indirectly, a collection, compilation, database, or directory without our prior written permission. Selling, reselling, licensing, sublicensing, or otherwise commercializing any content obtained from the Platform. Using the Platform to develop or train artificial intelligence models, machine learning systems, or other automated systems, whether for commercial or non-commercial purposes.

Disclaimer of Warranties

THE PLATFORM AND ALL CONTENT, SERVICES, AND FUNCTIONALITY OFFERED THROUGH THE PLATFORM ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER RIYADH RESIDENCES NOR ANY PERSON ASSOCIATED WITH RIYADH RESIDENCES MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE PLATFORM.

WITHOUT LIMITING THE FOREGOING, NEITHER RIYADH RESIDENCES NOR ANYONE ASSOCIATED WITH RIYADH RESIDENCES REPRESENTS OR WARRANTS THAT THE PLATFORM, ITS CONTENT, OR ANY SERVICES OR FUNCTIONALITY OFFERED THROUGH THE PLATFORM WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT THE PLATFORM OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE PLATFORM OR ANY SERVICES OR FUNCTIONALITY OFFERED THROUGH THE PLATFORM WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.

THE REAL ESTATE MARKET DATA, PRICING INFORMATION, INVESTMENT ANALYSIS, AND OTHER MARKET INTELLIGENCE PUBLISHED ON THE PLATFORM IS COMPILED FROM SOURCES BELIEVED TO BE RELIABLE BUT IS NOT GUARANTEED AS TO ITS ACCURACY, COMPLETENESS, OR TIMELINESS. REAL ESTATE MARKETS ARE INHERENTLY VOLATILE AND UNPREDICTABLE, AND PAST PERFORMANCE IS NOT INDICATIVE OF FUTURE RESULTS. ANY RELIANCE YOU PLACE ON PLATFORM CONTENT IS STRICTLY AT YOUR OWN RISK, as documented by Real Estate General Authority.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL RIYADH RESIDENCES, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE PLATFORM, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE PLATFORM OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

THE FOREGOING DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW. Indemnification

Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the laws of the jurisdiction in which the Vanderbilt Portfolio maintains its principal place of business, without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of or related to these Terms or the Platform shall be instituted exclusively in the courts of that jurisdiction, and you waive any objection to the exercise of jurisdiction over you by such courts and to venue in such courts.

Severability and Waiver

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of these Terms will continue in full force and effect.

No waiver by Riyadh Residences of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Riyadh Residences to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

Termination
